Legal Warranties and Consumer Rights
The PRODUCTS sold on the SITE comply with current regulations in France.
PRODUCTS delivered by the SELLER are automatically covered, in accordance with legal provisions and at no additional cost, regardless of the right of withdrawal:
- by the statutory warranty of conformity, for a PRODUCT that is visibly defective, damaged, or does not correspond to the ORDER,
- by the statutory warranty against hidden defects resulting from a defect in material, design, or workmanship affecting a delivered PRODUCT and rendering it unfit for its intended normal use, or rendering it so unfit for such use that it would not have been purchased, or would have been purchased only at a lower price, had the CUSTOMER been aware of the defect.
To exercise these rights, the CUSTOMER must notify the SELLER in writing of the non-conformity of the PRODUCT(S) or the existence of hidden defects.
Statutory Warranty of Conformity – Articles L217-1 et seq. of the Consumer Code
This warranty applies only to CUSTOMERS who meet the legal definition of a consumer, namely: “any natural person acting for purposes that fall outside the scope of their commercial, industrial, artisanal, or professional activity.”
When invoking the statutory warranty of conformity, the CUSTOMER has a period of two years from the DELIVERY of the ordered PRODUCTS to take action. The CUSTOMER is not required to provide proof of the existence of the lack of conformity on the date of DELIVERY of the PRODUCTS; however, such proof remains mandatory if the CUSTOMER must contact the carrier within the statutory 48-hour period to obtain a remedy.
The CUSTOMER may choose between repair or replacement of the PRODUCT, subject to the cost conditions set forth in Article L.217-9 of the French Consumer Code. The SELLER may refuse the CUSTOMER’s choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect.
If repair or replacement of the PRODUCT proves impossible, or if the requested remedy cannot be provided within one month (30 days) from the date of the CUSTOMER’s complaint, or if the remedy cannot be provided without causing significant inconvenience to the CUSTOMER, given the nature of the PRODUCT and its intended use,
the CUSTOMER may return the PRODUCT and receive a refund or keep the PRODUCT and receive a partial refund.
The application of the statutory warranty of conformity is free of charge to the CUSTOMER. The SELLER will cover all costs associated with the repair, replacement, and return of the PRODUCT.
Warranty Against Hidden Defects—Articles 1641 et seq. of the Civil Code
When exercising the warranty against hidden defects in the PRODUCT pursuant to Article 1641 of the Civil Code, the CUSTOMER has a period of two years from the discovery of the defect to take action. It is the CUSTOMER’s responsibility to provide proof of the defect’s existence as of the date of sale.
The CUSTOMER may choose between returning the PRODUCT in question and receiving a refund of the purchase price, or keeping the PRODUCT in question and receiving a partial refund of the purchase price.
Exercising the warranty against hidden defects is free of charge for the CUSTOMER.
Details Regarding Handcrafted and Custom-Made Products
In accordance with Article L221-28 of the French Consumer Code, PRODUCTS that are custom-made or personalized at the CUSTOMER’s request are not covered by the right of withdrawal. Due to their handcrafted and custom-made nature, each PRODUCT may vary slightly from the photos. These variations do not constitute defects.
In the event of a proven defect, the SELLER reserves the right to first offer a repair or replacement. A refund will be considered only as a last resort, in accordance with Article L217-10 of the French Consumer Code, and only if repair or replacement proves impossible or cannot be carried out within a reasonable timeframe.
The CUSTOMER is informed that the SELLER is not required to automatically accept a request for a full refund. Refunds, if applicable, will be granted only under the conditions and within the limits set forth in the aforementioned legal provisions. Shipping Insurance Effective July 1, all orders placed on the WEBSITE include shipping insurance, which protects the CUSTOMER against loss, theft, or damage occurring during transit. This insurance, currently provided by Colissimo/La Poste, allows for a partial or full refund of the order’s value in the event of an incident. The SELLER also informs the CUSTOMER that an extended insurance policy (ISITRANS by Generali) will soon be implemented to further improve the claims process.
Shipping Insurance
Effective July 1, all orders placed on the WEBSITE include shipping insurance that protects the CUSTOMER against loss, theft, or damage occurring during transit. This insurance, currently provided by Colissimo/La Poste, may result in a partial or full refund of the order’s value in the event of an incident, provided that the procedure is followed (see below). The SELLER also informs the CUSTOMER that supplementary insurance (ISITRANS by Generali) will soon be implemented to further improve the compensation procedures.
Liability for Transport-Related Damage
In accordance with Article L216-2 of the French Consumer Code, the risk of damage is transferred to the buyer upon personal delivery and receipt of the package.
It is the CUSTOMER’s responsibility to check the condition of the package upon delivery. In accordance with Article L133-3 of the French Commercial Code, any damage or irregularity related to shipping must be reported to the carrier within three days (excluding holidays) by certified letter with acknowledgment of receipt, accompanied by photos of the package (both interior AND exterior).
In the absence of such a formal report, no claim against the carrier will be accepted, and the SELLER cannot be held liable for damage occurring during transport if this procedure has not been followed.
If the CUSTOMER has chosen the carrier themselves, the risks associated with delivery are transferred to the CUSTOMER upon handover of the PRODUCT to the carrier (Article L216-5 of the French Consumer Code).
Burden of Proof and Good Faith
The CUSTOMER must be able to provide reliable, dated proof of any non-conformity or damage. The SELLER cannot be held liable for damage proven to have occurred after delivery and may refuse a refund request if no valid and conclusive proof is provided.
Delivery Times and Transparency
The CUSTOMER is fully informed, at the time of purchase, of the processing times specific to each PRODUCT. These processing times are clearly indicated on the PRODUCT pages, the selection pages, the shopping cart, and the confirmation email.
By placing an ORDER, the CUSTOMER acknowledges and accepts these timeframes, which form an integral part of the sales contract. Complaints relating solely to processing times already communicated at the time of the ORDER will not be considered valid grounds for cancellation or a refund.
Harassment and Abuse
The SELLER reserves the right to take legal action in the event of repeated threats, undue pressure, or harassment on the part of the CUSTOMER. All communications must remain respectful and constructive.
Modifications
The SELLER reserves the right to modify these Terms and Conditions at any time. The applicable version is the one in effect on the SITE at the time the ORDER is placed.
